They're running systematic, multi-brand distribution operations at scale. The top independent cross-brand operators each appear across more than 4,000 distinct brands in our dataset. Which Brands Are Most Contested
Seller density — unique sellers per tracked product, a metric stable regardless of catalog size — is the clearest signal of how much control a brand actually has over its own listings. High density means your products are effectively in an open market. In our current 3-month rolling dataset, Kirkland Signature runs 2.04 sellers per product, Elmer's 2.02, and Bath & Body Works 1.69. Bath & Body Works carries a brand control score of just 56.3 out of 100 despite being a recognized household brand with active retail enforcement. Hasbro sits at 1.51 sellers per product with a control score of 77.3 — more locked down, but still contested on nearly a third of its tracked catalog. The common thread: density above 1.5 sellers per product consistently signals that enforcement programs are reactive rather than systematic.
FBA Is the Buy Box Floor
Across brands with meaningful buy box volume in our dataset, 75.5% of buy box days went to FBA-fulfilled sellers. That's not a nudge — it's the structural reality of how Amazon allocates the buy box. A brand selling direct or through authorized resellers without FBA fulfillment is starting at a disadvantage before price or seller feedback even enter the equation. The implication for brand protection is underappreciated: unauthorized sellers who invest in FBA aren't just undercutting your price. They are structurally positioned to win the buy box more often than non-FBA authorized sellers. Cease-and-desist campaigns that ignore fulfillment structure are addressing symptoms, not cause.
What Effective Protection Actually Requires
The operators spanning thousands of brands aren't hiding. They're visible in the seller data — they just look like a different name on each listing. The challenge is connecting the dots: recognizing that the seller who appeared on your catalog this week has been running the same playbook across dozens of similar brands for 18 months. That cross-brand pattern recognition is where most brand teams fall short. Effective protection in 2026 requires three capabilities most brand teams lack: operator-level identification (the entity behind the storefront, not just the storefront name), cross-brand activity history (to gauge whether you're dealing with a one-time opportunist or a professional operator), and daily buy box monitoring (so new entrants surface in days, not on your next quarterly review). A seller who knows they won't be spotted for 90 days can extract significant revenue before any enforcement action begins.
